DECLARATION OF WORK ASSIGNED TO AN INTERNATIONAL PROFESSIONAL

Competent authority:
District Employment Office responsible for the location or permanent residence of the entity assigning work to an international professional.
For whom:
Citizens of the Republic of Armenia, the Republic of Belarus, the Republic of Georgia, the Republic of Moldova, the Russian Federation and Ukraine
Required documents:
- Scan of all completed pages of a valid travel document of the non-citizen,
- Signed declaration of clean criminal record of the employee (prepared by us),
- Signed power of attorney (prepared by us).
WORK PERMIT
Estimated processing time: 1 to 2 months
Permit validity period: 1 to 3 years
Competent authority:
Provincial Office responsible for the location of the entity employing work to a non-citizen.
For whom:
All non-citizens who are not exempt from the requirement to obtain a work permit
Required documents:
- A scan of all completed pages of the non-citizen’s valid travel document,
- Approval from the district governor (if required for a given position),
- Confirmation of meeting the requirements as indicated by the district governor,
- Confirmation of meeting the requirements as indicated by the district governor,
- Signed power of attorney (prepared by us).
TEMPORARY RESIDENCE AND WORK PERMIT (UNIFORM)
Estimated processing time: Extended waiting period, potentially up to 12 months
Permit validity period: 1 to 3 years
For whom:
A non-citizen who intends to stay in Poland for more than 3 months, with the primary purpose of employment, based on an employment contract or a civil law contract.
Required documents:
- 2 copies of the application for a temporary residence permit, completed in accordance with the instructions (to be completed by the non-citizen),
- Annex No. 1 (to be completed by the employer),
- Annex No. 1 (to be completed by the employer),
- A valid travel document of the non-citizen (a photocopy of all written pages, the original for inspection),
- Confirmation of payment of the stamp duty for the application and for the card,
- If exempt from the requirement to have a work permit – a document confirming the exemption conditions are met (e.g. a diploma from a Polish university for full-time studies),
- A certificate of no tax arrears or a declaration by the non-citizen stating no tax arrears are in the case of performing work under a contract for specific work,
- A document confirming that the non-citizen has health insurance or that the insurer will cover the costs of treatment in Poland (e.g. printouts from ZUS – ZUS RCA for the last 3 months with information on sending and confirmation),
- Information from the starosta about the inability to meet staffing needs on the local labor market for the job position offered to the non-citizen – required only when necessary.
PERMANENT RESIDENCE PERMIT
A permanent residence permit is an entitlement to reside in Poland for an indefinite period of time granted to a third-country national (i.e. a person who does not hold citizenship of one of the EU countries, Norway, Iceland, Liechtenstein or Switzerland) or to a stateless person, at their request, in specific cases.
A permanent residence permit is granted if a third-country national who:
- is a child of a Polish citizen, under his/her parental authority;
- is a child of a non-citizen who has been granted a permanent residence permit or a long-term EU resident permit,
- has a Polish Card or is a person of Polish origin – and intends to settle in Poland permanently,
- is in a marriage recognized by Polish law with a Polish citizen and meets two consecutive conditions (1-2), i.e.: 1- was in this marriage for at least 3 years before the date of submitting the application for a permanent residence permit,
- is a victim of human trafficking
- immediately before submitting the application for this permit, resided continuously in Poland for a period of no less than: 5 years in connection with granting him/her refugee status, granting subsidiary protection or consent to stay for humanitarian reasons, or 10 years on the basis of a consent for tolerated stay granted on the basis of Art. 351 points 1 or 3 of the Act on non-citizens,
- has been granted asylum in the territory of the Republic of Poland,
- is a citizen of the United Kingdom of Great Britain and Northern Ireland, referred to in art. 10 paragraph 1 letters b and d of the Withdrawal Agreement, who until 31 December 2020 performed work in the territory of the Republic of Poland as an employee posted by a foreign employer to the territory of the Republic of Poland and meets all of the specified conditions (1-3), i.e. 1 – he/she has been staying in Poland legally and continuously for at least 5 years immediately before submitting the application.
PESEL
What is this number in Poland and why is it necessary?
PESEL is a unique personal identifier that is assigned to every person residing in the country. It is an 11-digit individual identification number that uniquely identifies a specific natural person. The Polish PESEL is needed for many activities, such as opening a bank account, obtaining medical care or settling taxes.
Without PESEL:
It is not possible to access certain benefits, obtain certificates or complete settlements with the Tax Office (US) or the Social Insurance Institution (ZUS). In addition, it is not possible to conduct business or interact electronically with offices using a Trusted Profile, which also requires a PESEL number for creation.
